1031 EXCHANGE: PRIVACY POLICY AND PRACTICES
Informational Notice
Congress enacted the Financial Services Modernization Act (also known as “Gramm-Leach-Bliley,” or PL 106-102) which brought significant changes to the way banks and financial services companies maintain and disseminate information they gather with respect to their clients. Part of the Act requires financial services providers, including those who provide tax planning services, to describe to their clients how personal information about them is collected, disclosed, and maintained.
In the Course of facilitating 1031 exchanges, we have always been committed to protecting the privacy of the information our clients entrust to us. We are subject to rules of professional conduct, as well as, provisions of the Internal Revenue Code, which require clients’ information to be kept strictly confidential. While we do not believe that Gramm-Leach-Bliley has altered our responsibility to maintain the confidentiality of our clients, we are providing this notice to explain our privacy policy and practices.
Collection of Information
In the normal course of providing our clients with 1031 exchange services, we collect nonpublic personal information from the following sources:
- Directly from the client
- Government agencies and other third party sources, including information about the clients transactions
Disclosure of Information
We do not disclose any nonpublic personal information about our clients or former clients to anyone, except as permitted by law or previously authorized in writing by the client.
Maintenance of Information: Confidentiality and Security
We restrict access to nonpublic personal information about our clients to those employees who need to know the pertinent information to provide services to the client. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard our clients’ nonpublic personal information.
